In broad terms, a tree owner, and/or whoever has control over it (the duty holder), has a duty of care in both civil and criminal law to take reasonable management measures to avoid foreseeable injury or harm. Duty holders are expected to consider the risks posed by their trees and manage those risks in a reasonable and proportionate way. 

Whether it be a school playground or a domestic garden, an inspection would meet your legal duty of care and ensure that risks are kept to a safe level.

Trees & development

It is commonplace for a Local Authority to request all details regarding trees on a proposed development site and any that may be impacted upon.

In these instances, an assessment must be made of these trees in line with British standard 5837.

I am able to provide full planning support with regards to trees and having spent 8 years working as a Tree Officer within a Planning Dept, I have an excellent insight and understanding of this often complex procedure. In addition to this, I am able to provide any landscape detail that may be required in support of a planning application.

Woodland management

Advice to landowners on managing woodlands whether it be conifer plantation or Ancient woodland.

Tree Preservation Orders, Conservation Areas and the Hedgerow Act.

Advice to landowners on managing trees protected by TPOS or those set within a Conservation Area.

Advice on hedgerow matters.
